Terms of Service

The short version: Miss Spent is a spending-pause tool, not financial advice. The optional App Store unlock is a one-time purchase, never a subscription. Your ledger is local-first. Starting with Miss Spent 1.1, the main app may also mirror the ledger through your private iCloud account when available; earlier builds remain local to the device.
1. Agreement and App Store licence
These Terms of Service (“Terms”) are between you and Neon Tiger Labs LLC (“we,” “us,” “our”), a California limited liability company, and govern your use of the Miss Spent iOS app (the “App”) and misspent.app (the “Site”). If you do not agree, do not use the App or Site.
The App is licensed, not sold. Unless the App Store listing identifies a separate custom end-user licence agreement, Apple’s Standard Licensed Application End User License Agreement (the “Standard EULA”) governs the App licence. These Terms supplement the Standard EULA. If they conflict on a matter the Standard EULA controls, the Standard EULA governs that matter.
2. What Miss Spent is
Miss Spent is an anti-impulse-spending app fronted by the fictional “Accountability Dame.” The App lets you capture a potential purchase, pause before deciding, record the outcome, and review your own spending-pause history. The Site explains the product and links to the App Store.
3. What Miss Spent is not
Miss Spent is a money app with an attitude, not a financial adviser.
Nothing in the App or Site is financial, investment, tax, legal, credit, or debt advice. Miss Spent does not tell you what to invest in, does not evaluate your ability to afford a purchase, and does not know your complete financial circumstances. Your spending decisions are your own.
4. Eligibility
You must be legally able to enter into a binding agreement to accept these Terms. If you are using the App on a device or Apple account managed by another person or organization, you are responsible for complying with the rules that apply to that device or account.
5. Your ledger, images, and iCloud
Your ledger content, notes, links, and images remain yours. Miss Spent stores its ledger locally. Starting with Miss Spent 1.1, the Release main app may also mirror supported records and image data through the private CloudKit database associated with your Apple account when iCloud is available. Earlier public builds do not use that private mirror. Neon Tiger Labs does not operate a Miss Spent account or application server that receives your ledger and does not have application-level access to your private CloudKit records. When you provide a product link, the App may request a thumbnail directly from the source website or image host. When you export records or share content, you choose where that exported content goes. You are responsible for content after you send it to another app, person, or service.
6. One-time unlock, purchases, and refunds
The core Miss Spent experience is free. Miss Spent offers an optional one-time App Store unlock, never an auto-renewing subscription. The current U.S. unlock price is $19.99; regional prices may differ and future prices may change. The price and included extras shown in the App before purchase are the authoritative purchase terms for that transaction. The Site describes the same current offer on its pricing page.
Purchases and restores are processed by Apple through the App Store. Neon Tiger Labs does not receive your payment credentials and cannot directly charge, refund, or modify an App Store transaction. Refund eligibility and requests are handled by Apple under its rules and applicable law.
7. No purchases on the Site
The Site does not sell the App or take payment. Any purchase of Miss Spent occurs through Apple’s App Store.
8. Acceptable use
You agree not to:
- Use the App or Site for an unlawful purpose or to violate another person’s rights
- Attempt to access systems or data that are not intended for you
- Reverse engineer, decompile, disassemble, or attempt to derive source code except to the extent applicable law expressly permits despite this restriction
- Redistribute, sublicense, rent, lease, or resell the App except as permitted by the Standard EULA or applicable law
- Use Miss Spent’s fictional voice or output to represent that Neon Tiger Labs has given personalized financial advice
9. Intellectual property
Your user-entered content remains yours. Miss Spent, including the fictional character, name, copy, software, design, voice, visual identity, documentation, and Site content, is owned by Neon Tiger Labs LLC or its licensors and is protected by applicable intellectual-property law. No rights are granted except the limited rights expressly provided by these Terms, the Standard EULA, and applicable law.
10. App and Site changes
We may update the App, change or discontinue features, stop offering future downloads, or stop maintaining the Site. We do not promise that every feature, theme, voice, export format, or integration will remain available forever. Changes to a completed one-time App Store purchase remain subject to Apple’s rules and applicable consumer law.
11. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App or Site will be uninterrupted or error-free.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEON TIGER LABS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE APP, SITE, OR THESE TERMS, INCLUDING lost data, lost savings, or purchase decisions.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE APP, SITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO ACCESS MISS SPENT OR US$100. Some jurisdictions do not allow certain warranty exclusions or liability limitations, so some of the above may not apply to you.
13. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Neon Tiger Labs LLC and its officers, employees, and agents from third-party claims arising from your unlawful use of the App or Site, your violation of these Terms, or your infringement of another person’s rights.
14. Apple
Apple is not responsible for the App or its support. Apple and its subsidiaries have the rights provided to them under the Standard EULA and applicable App Store terms, including third-party-beneficiary rights where those terms provide them.
15. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules, except to the extent mandatory consumer law in your place of residence provides otherwise. Any court proceeding must be brought in a court with lawful jurisdiction over the dispute.
16. Changes to these Terms
We may update these Terms as the product, Site, or legal requirements change. We will update the effective date and, where appropriate, provide additional notice of material changes. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by applicable law. If you do not agree to revised Terms, stop using the App and Site.
17. Severability and entire agreement
If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. These Terms, the Privacy Policy, the Standard EULA, and applicable App Store terms form the agreement governing your use of Miss Spent.
